By accessing or using our website, placing an order, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using the site or placing an order.
1. Definitions & Interpretation
1.1. “Buyer,” “Customer,” or “You” refers to any individual or entity who places an order through our website.
1.2. “Order” means a completed purchase transaction that you submit via our website for one or more Products.
1.3. “Product(s)” means any PVC cards (e.g., ID cards, membership cards, gift cards) or accessories (e.g., lamination kits, protective sleeves) listed and sold on our website.
1.4. Headings are for convenience only and do not affect interpretation.
2. Acceptance of Terms
2.1. By placing an Order through our website, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and our Return & Refund Policy, which are incorporated herein by reference.
2.2. We reserve the right to update, modify, or replace any part of these Terms at any time. Any changes become effective upon posting the revised Terms on our website. It is your responsibility to review these Terms regularly. Continued use of our website or placing an Order after such changes constitutes acceptance of the revised Terms.
3. Account Registration & Security
3.1. In order to place an Order, you may need to register for an account on our website. You agree to provide accurate, current, and complete information and to keep your account information up to date.
3.2. You are responsible for maintaining the confidentiality of your account credentials (e.g., password, username) and for all activities that occur under your account.
3.3. You agree to notify us immediately if you become aware of any unauthorized use of your account or any other breach of security.
4. Product Information & Pricing
4.1. We strive to provide accurate descriptions, specifications, images, and pricing for all Products on our website. However, we do not warrant that product descriptions or other content are error-free, complete, or up to date.
4.2. All prices listed are in Indian Rupees (INR) and include applicable Goods and Services Tax (GST) unless otherwise specified. Shipping charges, if any, will be added at checkout.
4.3. We reserve the right to change prices, descriptions, features, or availability of any Product without prior notice. In the event of an obvious pricing error, we reserve the right to cancel any Order placed at an incorrect price.
5. Placing an Order & Payment
5.1. Order Submission
• To place an Order, select your desired Product(s), customize (if applicable), add to cart, and proceed through the checkout process.
• By clicking “Place Order” (or its equivalent), you make an offer to purchase the Product(s) in your cart subject to these Terms.
5.2. Order Confirmation
• After submitting your Order, you will receive an Order Confirmation email containing your order number, details of the Product(s), pricing, and estimated shipping timeline. This email is not an acceptance of your offer but an acknowledgment that we have received it.
• We reserve the right to accept or reject your Order in our sole discretion. Acceptance occurs when we send you a “Shipping Confirmation” email or, for custom-printed Products, a “Printing in Progress” notification.
5.3. Payment Methods
• We accept payment via major credit/debit cards, net banking, UPI, and select wallet services.
• By providing payment information, you represent and warrant that you are authorized to use the chosen payment method.
• You agree that we may charge the full amount (Product price, taxes, shipping) immediately upon Order acceptance.
5.4. Security & Fraud Prevention
• All payment transactions are encrypted and processed through secure third-party gateways. We do not store your full card details on our servers.
• We reserve the right to verify billing and shipping information, and to cancel any Order if we suspect fraudulent or unauthorized activity.
6. Customization & Artwork
6.1. Personalized Products
• For any custom-printed PVC card (e.g., logos, photographs, serial/barcodes), you must submit high-resolution artwork files (e.g., .AI, .EPS, .PDF, .PNG) that meet our specifications (minimum 300 DPI, CMYK color mode).
• By submitting artwork, you represent and warrant that you have all necessary rights, licenses, or permissions to use such artwork and that it does not infringe any third-party rights.
6.2. Design Proofs
• For complex or large-volume custom orders, we may provide a digital proof (PDF or JPEG) for your approval. You are responsible for carefully reviewing proofs and confirming to us that they are accurate.
• Once you approve a proof, all subsequent errors (e.g., spelling, layout) are your responsibility, and we are not liable for reprints due to customer-approved errors.
6.3. Production Timeline
• Custom-printed Orders typically require 5–7 business days for production after proof approval. Rush or expedited production may be available at an additional fee; please contact Support for details.
7. Shipping & Delivery
7.1. Domestic Shipping (Within India)
• Standard Orders (non-custom) ship within 2–3 business days of payment confirmation.
• Custom-printed Orders ship within 5–7 business days after proof approval.
• We use reputable courier partners (e.g., Blue Dart, DHL), and tracking information will be emailed once your Order ships.
7.2. International Shipping
• We ship to select countries outside India. Shipping times vary by destination (typically 7–14 business days).
• Import duties, taxes, customs clearance, and brokerage fees are the responsibility of the recipient.
7.3. Shipping Charges & Risk of Loss
• Shipping charges (if any) will be displayed at checkout and added to your Order total.
• Risk of loss or damage to Products passes to you upon delivery by the carrier at the address you provided. It is your responsibility to inspect the package upon delivery and notify us immediately of any shipping damage (see Return & Refund Policy).
7.4. Lost, Stolen, or Delayed Shipments
• If a carrier marks your Order as “Delivered” but you do not receive it, you must report it to us within 14 days. We will assist in filing a claim with the carrier.
• We cannot issue replacements or refunds until the carrier’s investigation is complete.
8. Return, Refund & Cancellation
8.1. Your right to return or cancel an Order is governed by our Return & Refund Policy, which is incorporated herein by reference. Please review it carefully before placing an Order.
8.2. To summarize:
• Returns for change-of-mind are accepted within 15 days of delivery (subject to conditions).
• Defective or incorrect items may be returned within 7 days of delivery with photographic proof.
• Custom-printed or personalized products are non-returnable unless there is a printing/manufacturing defect or an incorrect item was shipped.
• Order cancellations prior to production receive a full refund; cancellations after production begins are treated as change-of-mind returns (if eligible).
9. Intellectual Property & License
9.1. Website Content
• All content on our website, including text, graphics, logos, images, product descriptions, design templates, and software (“Site Content”), is the property of E-Card Service or licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws.
• Except as expressly authorized in writing, you may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Site Content.
9.2. Submitted Artwork
• By submitting artwork or logos for custom printing, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and print the artwork solely for fulfilling your Order and providing related services.
9.3. User-Generated Content
• If you leave reviews, testimonials, or comments on our website, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and distribute that content in connection with our marketing, advertising, or promotional efforts.
9.4. Trademarks
• “E-Card Service” and our logo are trademarks or registered trademarks of E-Card Service. All other product or company names mentioned on the Site may be trademarks of their respective owners.

11. Disclaimers & Limitation of Liability
11.1. No Warranty
• TO THE FULLEST EXTENT PERMITTED BY LAW, OUR PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.
• We do not guarantee that the website will be uninterrupted or error-free, that defects will be corrected, or that the site or our servers are free of viruses or other harmful components.
11.2. Limitation of Liability
• TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL E-CARD SERVICE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF THE SITE OR PRODUCTS, OR ANY INFORMATION, SOFTWARE, OR SERVICES PROVIDED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICABLE ORDER DURING THE PRIOR SIX (6) MONTHS.
12. Indemnification
You agree to defend, indemnify, and hold harmless E-Card Service, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your breach or alleged breach of these Terms;
• Your violation of any law or third-party right (including intellectual property, privacy, or publicity rights);
• Artwork, designs, or content you submit that infringe on third-party rights; or
• Any negligent or willful acts or omissions by you in connection with your use of the Site or purchase of Products.
13. Governing Law & Dispute Resolution
13.1. Governing Law
• These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of India without regard to conflict-of-law principles.
13.2. Informal Resolution
• Before initiating any legal action, you and E-Card Service agree to attempt to resolve any dispute informally via written notice and negotiation for at least thirty (30) days.
13.3. Arbitration
• If the dispute is not resolved informally, you and E-Card Service agree that any controversy or claim arising out of or relating to these Terms, your use of the Site, or the purchase of Products shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended), conducted in Kolkata, West Bengal, India. The arbitration shall be administered by a single arbitrator mutually agreed upon.
• The arbitrator’s decision shall be final and binding, and judgment on the award rendered may be entered in any court having jurisdiction. The language of the arbitration shall be English.
13.4. Small Claims & Injunctive Relief
• Notwithstanding the above, either party may bring a lawsuit in a court of competent jurisdiction for injunctive relief to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights. Claims not subject to arbitration (e.g., injunctive relief, disputes involving third parties) may be brought in the appropriate courts in Kolkata, West Bengal, India.
14. Severability & Waiver
14.1. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the intent of the original.
14.2. No waiver of any term or condition in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to enforce a right shall not constitute a waiver.
15. Miscellaneous
15.1. Assignment
• You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or delegate our rights and obligations at any time.
15.2. Force Majeure
• Neither party shall be liable for any failure or delay in performing its obligations under these Terms (other than payment obligations) if caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, pandemics, governmental actions, or failures of suppliers or carriers.
15.3. Entire Agreement
• These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and E-Card Service regarding your use of the Site and purchase of Products, superseding any prior or contemporaneous agreements, understandings, or communications.
